1. The Registration of contractors to be considered upto the work valve of Rs.5.00 Lakhs in three classes as shown in the following table referring to the solvency required, Annual average turn over, cost of work in hand and registration fees payable.

2. For works having estimated cost upto Rs.5.00 Lakhs, tender may be called for from registered contractors or those who may register during the tendering process. In addition, NIT will be published in a local Newspaper and Port website for such works with the stipulation that intending tenderers other than registered contractors should seek registration before submitting their tenders. Only the financial Bids of the registered contractors / tenderers registering during the bid process will be evaluated.
3. In respect of works costing more than Rs.5.00 Lakhs, Notice Inviting Tenders will continue to be published in Newspapers and website by following Two cover system with pre-qualification criteria for each tender. The financial / Price Bids of the technically pre-qualified bidders will only be evaluated.
For Registration the contractor shall submit an application in the prescribed form on payment Rs.50/- + VAT 4% towards cost of application form . The application form shall be accompanied by necessary supporting documents in fulfillment of the conditions required for Registration under a particular category. Promotion from one class to another is permissible based on merit decided by competent authority taking into account the cost of works in hand and average Annual turn over as specified in Rules. Confidential report shall be maintained by port for each contractor based on the performance during the execution of work.
Norms for issue of tender
In respect of works costing upto Rs.5.00 Lakhs, the work is awarded on contract through tenders by issuing tender schedule to the registered contractors only.
Norms for issue of NIT
In respect of works costing more than 5.00 Lakhs, the work is awarded by issuing NIT to the Registered Contractors as well as publishing NIT in brief in leading News papers and Port website as detailed below:

The tender schedule will be issued to the contractors Registered in the category eligible to quote for such work. If unregistered contractor wishes to purchase tender schedule, he shall apply for Registration with all requisite particulars along with Registration fee and seek registration before submitting their tender.
Validity of registration
The Registration is valid for 3 years from the date of issue. The contractor shall get the Registration renewed for a further period of 3 years on production of fresh solvency certificate, a copy of latest assessment order of the Income Tax Department or a copy of acknowledgment of Income Tax return for the latest assessment year etc. If he failed to do so, the registration will be treated as canceled and he should apply for fresh registration.
Cancellation of registration
The names of contractors who have not tendered for any work for a period of 3 years and those who have failed to secure any contract during the period of 5 years in the Port Trust and those who have not furnished the annual return will be removed from the Register of approved contractors. If the contractor whose name has been removed, desired to take up contracts subsequently, he should apply for re- enrollment on payment of prescribed fee which shall be considered on its merits.
Appeal
Any contractor rejected / removed or reduction of class by CE/CME under his own authority may appeal to Chairman,Port Trust against the order of such reduction/removal within a period of 2 months and the decision of Chairman shall be final.
Tendering procedure
Tenders are awarded to the lowest tenderer. In major works and specialized works tenders are called for in two cover system, i.e Technical Bid and Price Bid. The Price bids of those who were technically qualified would be opened.
The pre-qualification criteria, performance criteria and evaluation criteria would be incorporated in the bid documents in clear and unambiguous terms.
Negotiations
Normally contract will be awarded to the lowest tenderer. In cases where the Port is of the opinion that the amount quoted by L.1 is on the higher side, Port may go in for negotiation. Negotiation will be conducted only with L1.
No contractor may be registered without full inquiry as to his stability in regard to:
(a). Financial status supported by a certificate of solvency obtained from the Collector of the district or banker's certificate.
Note.1: A solvency certificate shall not be accepted for the purpose of registration more than 12 months after the date on which it was granted.
Note.2: A banker's certificate which brings out the financial soundness of the contractor, (to the extent required for the relevant category) shall be accepted. No distinction like scheduled or non- scheduled be made for this purpose.
Note.3: Solvency certificate in the name of a firm need not be insisted upon if such a certificate for the required in the name of one or more partners is forthcoming and it is made clear in the partnership deed that all the partners are jointly and severely responsible to meet all liabilities over and above the business of the firm.
(b). Professional capacity and reliability supported by certificates or recommendations of Officers of Government or Public Bodies who have had personal knowledge of the applicant and his work.
Note.1: The experience gained by an individual partner in the execution of works in the past may be taken into consideration while deciding the category of the contractors if the partner concerned has to his credit execution of such works by virtue of monetary share and other interests. Experience gained merely as a servant may not count as proof of the capability of the firm as a whole.
Note.2 The officer concerned recommending sanction shall ensure that the contractors have the required experience and that they have undertaken works of sufficient magnitude justifying their competency to take up the works in the class which they seek enrollment. If the criteria given in the rule 5 below is not fulfilled there would be no necessary of forwarding application to the registering authority.
i. For registration, the contractor shall submit an application in the form in Annexure-A to the Chief Engineer / Chief Mechanical Engineer & Electrical for respective type of works. The application shall accompanied by necessary documents referred to in the Rule-2(a) & 9b). The cost of the application form is Rs.50/- + VAT 4%
ii. The contractor applying for registration shall pay 50% of the registration fees which will be non-refundable along with his application form for the class in which he intends to get himself registered . If his application is accepted , he shall pay the remaining 50% registration fees within two weeks from the date of receipt of intimation of acceptance of his registration.
iii. If as a result of the scrutiny of the application a particular contractor is not found suitable for 'D” class for which he has applied for registration, the concerned authority may consider his application for registration to the next lowest class 'E' which case a separate application for registration will not be required.
Note.1: The Chief Engineer/Chief Mechanical Engineer ( Mech & Elec) shall fix a day on which he will personally examine the application and if the application do not contain complete information, the applicants shall be called and explained what is required and return the applications for resubmission.
Note.2: Every change in partners and leading technical employees will be intimated by the contractor to the registering authority forthwith.
If any of the contractors are specialized in one or more distinct types of works mentioned below, the fact should be noted against their names in the register of approved contractors:-
1. General Engineering( Which includes building works and other works like sanitary and water fittings of buildings)
2. Steel structural work and other building work including sanitary and water fittings requiring specialization.
3. Water supply
4. Drainage
5. Pile foundations for buildings
6. Special asphaltic works
7. Marine structure
such specialization shall be treated as an additional qualification though there shall be no attempt to restrict the competition only to those who are specialized in the particular line.
Promotion from one class to another is permissible on payment of the difference in the registration fee. Such promotion should be made on merits by the competent authority taking into account the cost of works in hand and the annual average turnover etc. as specified under Rule No.1.
Note: Subsequent to the initial registration in a particular category, applicants for upgrading to a higher category will not be considered unless the contractors have carried out some works or works of Port Trust of of Corporate or Public bodies in the category in which they were registered earlier.
A retired member of the Armed forces desirous of starting of business as an approved contractor may be registered in 'E” class on obtaining from him a simple application supported by a certificate of his having served in the Armed forces and solvency certificate along with registration fees.
The graduate and diploma holders in Civil Engineering who have passed the qualifying examination and have respectively the degree and diploma from the recognized Universities and Institutions may get themselves directly registered both the classes by applying in the prescribed form in ANNEXURE-E to be accompanied by a degree / diploma certificate and solvency certificate and on payment of (i) Earnest Money and (ii) Performance security to the extent of 50% of what is normally due in each case. In respect of remaining 50% of the Performance security, a nominal amount of 1% of the estimated cost subject to a minimum amount of Rs.100/-shall be covered initially and the rest by a prorate deduction from bills.
Note: The above concession will be available for a period of 5 years from the date of passing the respective degree and diploma examination.
A labourer's co-operative society shall be given registration in both the classes on its applying in the prescribed form accompanied by a certificate from the Registrar of Co-operative societies regarding its capacity and financial resources in lieu of solvency or banker's certificate, a certificate of professional capacity from the officer of the Government or Public body in whose division it has carried out works and necessary registration fees. Such registration will be valid for a period of 3 years from the date of issue of orders provided the society remains registered with the Registrar during the period and shall be renewed on production of fresh certificate from the Registrar regarding its capacity and financial resources before expiry of the validity period.
A register of approved contractors shall be maintained by the CE/CME/Chief Engineer (Mech&Elec) in his office in the form prescribed in Annexure-B. The register shall be examined by the Chief Engineer/CME /Chief Engineer ( Mech& Elec) on 1st July each year and at other times, if found necessary on report of specific failure or default by a contractor, and if he considers that the financial circumstances or technical capacity of a contractor has so deteriorated that he ought to be removed from the register or placed in a lower class, he may proceed to do so after calling on the contractor to state within a fixed time as to why such action has been proposed against him. Action as taken should be intimated to all concerned. Whenever a contractor is either removed from the approved list or down graded to lower class he will not be entitled to any refund of registration fees.
Note: The divisional Engineers shall report confidentially in the form prescribed in Annexure-C to the registering authority on 1st June each year, the cases of contractors who are habitual bad workers and create obstruction in the works, to enable that authority to take this into consideration at the time of review for renewing the registration. The report for both referred to above shall be in a narrative form.
The registration once done on merits will be valid for a period of 3 years from the date of order sanctioning the registration irrespective of the date of issue of registration certificate by the concerned authority on payment of balance of the registration fees. The contractor should get the registration renewed for a further period of 3 years on production of fresh solvency certificate of appropriate category before expiry of its validity. If he fails to do this, the registration should be treated as canceled and he should be asked to apply DENOVE registration.
Special requirements such as electrical licenses, plumping licenses etc which may be required for particular categories of work like electrical installation etc. will have to be fulfilled by the contractors whenever such special works are involved.
The names of contractors who have not tendered for any works for a period of 3 years and those who having tendered failed to secure any contract during the period of 5 years in the Port trust should be removed from the register of approved contractors. The Chief Engineer/CME /Chief Engineer ( Mech& Elec) shall review the registration effected by him every year for taking action for removal or reduction of contractors.
For facilitating such scrutiny, the contractors should be required to submit to the Chief Engineer/CME /Chief Engineer ( Mech& Elec) an annual return ending April every year in the form prescribed in Annexure-D with remarks regarding performance from the Divisional Engineers in whose division the contractors undertook the works shown in the return. The annual returns in the case of all contractors shall be submitted to the Chief Engineer/CME /Chief Engineer ( Mech& Elec) by the concerned divisional officers
Note: As there is a possibility of contractors omitting in their returns, the works for which the performance is not satisfactory, the officers should take the following precautions:-
“Whenever, it is observed that the performance of contractor is not satisfactory and some action towards his down grading or removal from the particular category is necessary, the concerned Divisional Engineer shall report in detail the matter to the Chief Engineer /CME /Chief Engineer( Mech& Elec) for taking necessary action. The authority competent to register contractors in a particular clause would also be competent order degradation or reduction of the class”.
If a contractor whose name has been removed, subsequently desired to take up contracts, he should apply for re-enrollment on payment of the prescribed fees. Such applications shall be considered on its merits.
The work of registration of contractors or their removal or reduction will be done by the Chief Engineer/CME /Chief Engineer ( Mech& Elec) under his own authority.
Any contractor rejected, removed or reduced by the Chief Engineer/CME /Chief Engineer ( Mech& Elec) under his own authority may appeal to the Chairman, Tuticorin Port Trust against the orders of reduction or removal and the decisions of the Chairman will be final.
